A legal practitioner, Festus Ogun, has filed a case in court, challenging the legality of the continuous stay in office of the Inspector General of Police, despite reaching his retirement age.
In the case filed at a Federal High Court, Abeokuta, with Festus Ogun as the plaintiff and Usman Alkali Baba, the IG of Police, President of the Federal Republic of Nigeria, the Attorney General of the Federation, and the Nigeria Police Council as defendants, Ogun is asking the court to determine “whether upon a proper construction of section 215(1)a of the 1999 constitution of the Federal Republic of Nigeria, as amended and sections 7(3) and 18(8) of the police act, 2020, the 1st defendant can validly continue occupying and functioning in office as the inspector general of police having clocked the statutory retirement age.”
In the originating summon seen by Prime Progress, the legal practitioner also asked the court to amongst other things determine “whether upon a calm consideration of sections 215(1)a of the 1999 Constitution of the Federal Republic of Nigeria, as amended, sections 7(3) and 18(8) of the police act, 2020, the 1st defendant’s continuous occupation of the office of the inspector general of police, after clocking statutory retirement age, is not illegal and unconstitutional.”
Ogun prayed the court to declare that the IGP “is a retired member of the Nigeria Police Force” and that the IGP’s “continuous occupation and functioning in office as Inspector General of Police after reaching or clocking the statutory retirement age is illegal, unconstitutional, arbitrary and wrongful.”

The defendants in the case include the IG of Police, the President of Nigeria, the Attorney General of the Federation, and the Nigeria Police Council. Ogun is seeking the court's interpretation of specific sections of the Nigerian Constitution and the Police Act, questioning whether the IG can legally continue his duties after reaching the mandatory retirement age.
Ogun argues that the IG's continued service is illegal and unconstitutional and has requested the court to declare the IG a retired member of the Nigeria Police Force and to affirm that his continuation in office is unlawful and wrongful.
